This standard is accepted and applied by the contract boards and trial courts in reviewing default terminations for failure to make progress. Indeed, the Boards of Contract Appeals, whose specialized expertise with government contracts is entitled to respect, have long adopted the Lisbon standard in reviewing the government's default termination of contractors who allegedly failed to prosecute their work with diligence.
